Is mediation the right next step?
Mediation is not right for every dispute, but it may be worth considering
where one or more of the following factors are present.
Management time
Management attention is being diverted.
Rising
costs
Costs and uncertainty continue to increase.
Entrenched positions
Progress has stalled and positions have hardened.
Strained relationships
Commercial relationships are under pressure.
Reputation and confidentiality
Privacy, reputation or commercial sensitivity matter.
Stalled negotiations
Direct negotiations are no longer moving forward.
Risk and
options
Testing assumptions and exploring options.
Commercial value
A practical outcome may offer greater value than continuing.
| The legal issues may define the dispute. Understanding the wider picture often creates the opportunity for progress. |
Gregory's approach
Gregory creates a calm and informal environment in which people can speak openly, while remaining prepared to test positions, assumptions and risk where that may help move the discussion forward.
Experience and insight
Experience that brings perspective, pattern recognition and practical insight.
Active mediation
Relaxed enough for candid conversation. Active enough to maintain momentum.
Commercial understanding
Recognising the legal, commercial and human factors shaping the dispute.
Practical outcomes
Drawing out underlying interests, identifying non-negotiables and helping parties assess realistic options.
| Clear thinking | Constructive conversations | Practical progress |
Proposing a mediator requires confidence in both the mediator and the process. Gregory prepares carefully, creates conditions for candid conversation, and remains ready to test positions, assumptions, and risks where that may help the parties make progress.
Gregory works closely with lawyers before and throughout mediation, bringing careful preparation, commercial perspective and constructive challenge to the process.

Careful
