Commercial mediation focused on
finding a workable way forward

Illuminated pathway_edited.jpg

When a commercial dispute reaches a point where progress is difficult, mediation creates space to step back, understand what is driving the dispute and explore a practical way forward.

Mediation can help parties test positions, consider commercial priorities and explore options outside the constraints of continuing negotiation or formal proceedings.

Confidential enquiries are welcome from businesses, professionals and lawyers.

What is commercial mediation?

Commercial mediation is a confidential process in which an independent mediator helps those involved in a dispute explore whether they can find a workable way forward.

The mediator does not decide the outcome. Instead, mediation creates an opportunity to examine the issues, understand different perspectives and explore possible solutions outside the constraints of continuing negotiation or formal proceedings.

It can create room for conversations that may be difficult to have elsewhere, while keeping decisions about any resolution with the parties themselves.

When can  mediation help?

Mediation can be considered at different stages of a commercial dispute, whether discussions have stalled, positions have become entrenched or formal proceedings are already underway.

When direct discussions have stalled
There may still be scope for agreement, but progress between the parties has

become difficult.

When commercial relationships matter
A dispute may need resolving without losing sight of an ongoing business or

professional relationship.

When proceedings are underway
Mediation can provide an opportunity to explore resolution alongside formal

legal proceedings.

When a practical solution is needed
The parties may wish to explore practical or commercial options that a

formal determination alone may not address.

A commercial approach to mediation

Gregory's approach is grounded in commercial reality.

Drawing on more than 30 years' experience in dispute resolution, Gregory works with parties and their advisers to understand the issues, identify what matters and explore whether there is a workable route forward.

His approach is constructive and pragmatic, creating space for meaningful discussion while keeping commercial realities firmly in view.

'Sometimes, asking a different question opens up a different conversation'.

Representative areas of experience

Gregory maintains a deliberately broad mediation practice. He is comfortable getting to grips quickly with complex facts, detailed contractual or financial issues and disputes involving ongoing business or personal relationships.

Commercial and contractual disputes

Contractual issues involving wider questions of commercial risk, cost, relationships and practical business impact.

Shareholder and partnership disputes

Ownership and competing interests, often involving relationships, future decision-making and business continuity.

Property and construction disputes

Property or project issues involving commercial pressures, competing priorities and the practical consequences of delay.

Professional services disputes
Disputes involving professional firms, advisers and clients, where legal, commercial and reputational considerations intersect.

Travel, tourism, sport and leisure
Commercial disputes involving operational pressures, contractual relationships and reputation.

Business and organisational disputes
Where commercial pressures, operational priorities and important working relationships all influence what a workable outcome needs to achieve.

Insurance-related disputes
Where differing positions on liability and financial exposure sit alongside wider commercial and practical considerations.

Multi-party and complex disputes
Where different interests, interconnected issues and competing priorities can make finding common ground particularly challenging.

This is not an exhaustive list. Gregory's mediation practice is deliberately broad, reflecting the reality that commercial disputes rarely fit neatly into a single category.
